The restaurant, which was set to open in May and then had a preview at the Wells Street Art Festival, may now get pushed back due to a legal battle between co-owner Anthony Tomaska and his former partners in 33 Club, Jerry Kleiner and Sam Madonia. Tomaska is suing the others for alleged fraud and breach of fiduciary duty, seeking a collective $2.9 million in damages.
